Admission Agreement (Dated: 06/09/2023), Medical Assessment (Dated: 05/27/2026), Charting Notes (Dated: 08/02/2026-08/21/2026), Individualized Service Plan (Dated: 07/20/2026), Hospice Progress Notes (Dated: 07/31/2026, 08/12/2026, 08/13/2026, 08/14/2026, 08/17/2026), Physician’s Orders (Dated: 08/21/2026), Hospice Plan Of Care (Dated: 12/02/2025), and Oakmont Private Companion Services (Dated: 08/26/2025).

The investigation revealed the following: Allegation- Resident sustained multiple bruises due to staff neglect or physical abuse.

The details of the complaint alleged that the resident sustained multiple bruises due to staff neglect or physical abuse. On 8/21/2026, from 1:30pm-3:00pm, the department interviewed staff (S1-S5) and resident (R2) and attempted to interview resident R1. However, resident (R1) could not participate in the interview process due to cognitive difficulties. On 09/30/26, the department interviewed residents (R3-R7). 5 of 5 staff denied any type of abuse or staff neglect. All staff stated that they saw bruises and redness on resident (R1) but did not know how the bruising occurred. They stated once they saw the bruises and redness on the resident, they informed hospice and the family. Staff also stated that the resident has a history of having sensitive skin and when the bruises were found they were documented in the charting notes for the resident.

The department interviewed residents (R2-R7) about the allegation and 6 of 6 residents that were interviewed could not corroborate the allegation. The majority of the residents stated that they have not witnessed or been a victim of staff neglect or physical abuse. They stated that they feel they are getting good care from the staff. Resident (R1) could not participate in the interview process due to cognitive difficulties.

The department reviewed the Charting Notes (Dated: 08/02/2026-08/21/2026) and observed that on 08/07/26 that the resident was noted with discoloration under their left arm and on 08/10/26 a caregiver observed the resident to have discoloration on their leg and noted the resident had no pain or discomfort. The department reviewed the Physician’s Orders (Dated: 08/21/2026) and observed that the resident is on medications that may cause a skin rash, redness, and unusual bruising of the skin. The department also reviewed the Medical Assessment (Dated: 05/27/2026) and observed the resident has a history of skin condition or breakdown. The department did not find a preponderance of evidence to suggest physical abuse or staff neglect.

Based on interviews and records reviewed, there is insufficient evidence to support the allegation that Resident sustained multiple bruises due to staff neglect or physical abuse. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is Unsubstantiated.

An exit interview was conducted with Herandy Ramirez, Business Office Director, and a hard copy of this Complaint Investigation Report was provided.
