Regarding the allegation: Staff inappropriately restrained a resident while in care. It is alleged that resident #1 (R1) was restrained to their bed. During LPA’s interview with the reporting party they stated they never observed/witness R1 restrained to their bed, but they were told by a witness. During LPA’s interview with staff #1 (S1) they confirmed that R1 was never restrained to their bed although R1 was aggressive, broke a bed and punched one (1) of their walls. Furthermore, S1 stated R1 was under Hospice Care and had a personal caregiver that visited R1 and they would have reported this before. During LPA’s interview with R1’s brother, R1’s brother did admit that R1 was aggressive and needed help, that’s why R1 was in facility but also never visited R1 because they live out of state. LPA attempted to interview one (1) of R1’s friends but that friend did not want to speak to LPA. LPA interviewed witness #1 that the reporting party provided, and this witness confirmed that R1 was very aggressive but could not remember if R1 was restrained to a bed. LPA interviewed an additional staff (S2) and they also confirmed that R1 was never restrained to their bed. LPA could not interview R1 because R1 is now deceased. During the physical tour, LPA did not witness/observe any residents restrained. LPA also interviewed (2) residents that said they have never been retrained to their bed. Furthermore, one (1) out of the two (2) residents that were interviewed was R1's prior roommate and stated R1 was a really aggressive person and R1 would also hit the staff and also confirmed that R1 was not restrained to their bed because R1 would be laid out on the floor screaming and R1 also stole from them. Therefore, based on the interviews conducted and the allegation(s) is UNSUBSTANTIATED at this time.

Regarding the allegation: Staff did not meet a resident's incontinence needs. It is alleged that Resident #1 (R1)’s incontinence needs were not met. During LPA’s interview with the reporting party they stated they hired a caregiver for R1 to be at the above facility for 8 (eight) and/or 10 (ten) hours a day for about two (2) weeks of R1 residing at the above facility. LPA asked Reporting party if they ever observed/witness R1 being in soiled diapers and reporting party stated no but they were told because they live out of state. During LPA’s interview with staff #1 (S1) they confirmed that R1 did have a caregiver at the beginning of them residing at the above facility but the hired caregiver for R1 only sat there for companionship and stayed for two (2) hours and they did not provide care for R1. S1 stated my staff provided the care for R1; furthermore, R1 was also under Hospice Care because of R1’s health deteriorating so R1 was also receiving help from a hospice staff. LPA reviewed and obtained R1’s Hospice Paperwork, Medical Assessment, Preplacement Appraisal, Resident Appraisal that confirm R1 was incontinent. LPA could not interview R1 because R1 is now deceased. LPA interviewed R1’s brother that confirmed R1 needed incontinent care but because they lived out of state, they did not know what care the facility was providing and they also never visited R1. LPA attempted to interview one (1) of R1’s friends but that friend refused to talk to LPA. LPA interviewed witness #1 that the reporting party provided, and they do not remember R1 being in soiled diapers. LPA interviewed an additional staff (S2) and they confirmed that all the residents get changed several times a day. During LPA’s physical tour, LPA did not witness/observe any residents in soiled diapers. LPA also interviewed (2) residents that said they do use diapers and staff change them several times a day. Therefore, based on the interviews conducted the allegation(s) is UNSUBSTANTIATED at this time.

Regarding the allegation: Staff did not provide an authorized representative with an admission agreement. It is alleged that the authorized representative did not receive a copy of Resident #1 (R1)’s admission agreement. During LPA’s interview with the Reporting Party (RP), which is also R1’s trustee, they confirmed that the facility did not provide them with a copy of the admission agreement. LPA asked the reporting party when they became R1’s trustee and they confirmed that their spouse was the trustee but something happened to them, and they recently became the trustee. During LPA’s interview with staff #1 (S1) confirmed that the admission agreement was sent to R1’s brother and was signed by R1’s brother because R1’s brother was also power of attorney. S1 also confirmed that both R1’s brother and R1’s trustee both live out of state and it was difficult to receive information from both and have both sign documents but R1’s brother signed and dated the admission agreement. LPA received a copy of R1’s admission agreement, Preplacement Appraisal, Resident Appraisal and Identification and Emergency Information all signed by R1’s brother. LPA also received a copy of R1’s Medical Assessment. LPA asked S1 how they confirmed that R1 had a power of attorney and S1 stated that R1 was referred by an agency and this is how they verified the information but also that both of the power of attorneys never came to the above facility to visit R1 everything was via telephone and sent via post office and/or email. Additionally, both parties were also aware that R1 was moved to the sister facility because R1 was having issues at the above facility and both agreed to move R1 via telephone and another admission agreement had to be signed and dated by R1’s brother who was the only person responding to S1’s request. LPA contacted R1’s brother and R1’s brother did confirm that they received signed and dated R1’s admission agreement. Therefore, based on the interviews conducted and paperwork received and reviewed the allegation(s) is UNSUBSTANTIATED at this time.

An exit interview was conducted, no citation(s) were issue, and a copy of this report was given to the Administrator.
