It was alleged that staff turned off the air and let Resident #1 (R1) room get to 90 degrees. LPA toured the facility and observed that all facility thermostats were set between 76-78 degrees Fahrenheit and would kick on when necessary. LPA observed the facility to be at a comfortable temperature with the thermostats in the facility hallways and not in the individual resident rooms. LPA observed a picture that was sent to the Department of a screen shot showing that it was 90 degrees in the city that the facility resided in. LPA observed a picture sent to the Department of an illegible thermostat number on the screen.

LPA interviewed 6 residents and 5 of 6 residents informed LPA that the staff keep the facility at a comfortable temperature even throughout the summer. 4 of 6 residents informed LPA that staff turn off the air conditioning at night and they are still comfortable with the internal facility temperature. 1 of 6 residents informed LPA that the temperature in their room varies.

R1 informed LPA that there is no problem with the facility air conditioning since it had been addressed.

LPA interviewed 5 staff and 5 of 5 staff informed LPA that they turn the air conditioning down or off at night due to the residents complaining that they were cold. 5 of 5 staff informed LPA that if the temperature gets to warm, then they will turn the air conditioner back on as soon as they are notified by a resident. 2 of 5 staff informed LPA that when R1 requested for the air to be turned back on, staff obliged immediately.

Regulations state the temperature of the facility must be maintained at a comfortable temperature and must not exceed 85 degrees Fahrenheit. Therefore, this allegation is deemed UNSUBSTANTIATED.

Regarding the allegations of Staff communicate inappropriately to resident in care and Staff do not treat resident with dignity and/or respect revealed the following: It was alleged that when R1 requested for the air conditioner to be turned back on Staff #1 (S1) spoke to R1 inappropriately and did not treat them with respect. LPA reviewed an incident report regarding R1 that on July 23rd, 2026, R1 was seen insulting and screaming at S1 when approached about the air conditioning being turned down at 7pm in R1s hallway.

LPA interviewed 6 residents and 6 of 6 residents stated that staff are always kind and treats all residents with respect when communicating. 6 of 6 residents informed LPA they have no issue with the staff at the facility. 1 of 6 residents informed LPA that they have overheard R1 giving staff a hard time on many occasions.

LPA interviewed 5 staff and 5 of 5 staff denied the allegation and informed LPA that they have been spoken to inappropriately and received verbal abuse from R1, including S1.

Therefore, this allegation is deemed UNSUBSTANTIATED.

Regarding the facility allegation of Staff did not seek medical attention to resident in a timely manner revealed the following: It was alleged that R1 had a medical emergency and S1 delayed calling emergency services due to passing dinner trays on October 25th, 2025. LPA reviewed an incident report for R1 stating that on October 30th, 2025, R1 sustained a fall and called for assistance. Staff went to R1s room to assist and R1 refused to go to the hospital. LPA reviewed another incident report dated November 5, 2025, stating that R1 requested to go to the hospital due to pain and emergency services was called for transport. LPA did not review an incident report dated October 25th 2025, for R1.

LPA interviewed 6 residents and 6 of 6 residents informed LPA that staff assist them with all their needs. 3 of 6 residents informed LPA that they have had a medical emergency while at the facility and staff assisted them in a timely manner.

LPA interviewed 5 staff and 3 of 5 staff could recall a fall in October of 2025 for R1. 3 of 5 staff informed LPA that R1 refused to go to the hospital initially and was sent at a later time when R1 expressed pain. 1 of 5 staff informed LPA that they answered the phone and spoke to R1 when the incident occurred and R1 denied emergency transport over the phone and then again once staff entered R1s room. S1 informed LPA that they went to R1s room, called 911 right away and R1 initially refused to go to the hospital.

Therefore, this allegation is deemed UNSUBSTANTIATED.

LPA reviewed S1s training and observed updated staff training's on topics such as psychosocial needs of the elderly, mandated reporter abuse, resident rights and 911 calls for falls.

Based on information gathered and interviews conducted, the Department is unable to ascertain if the above allegations occurred as reported. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove or refute the alleged violation occurred; therefore, the allegations are deemed UNSUBSTANTIATED. An exit interview was conducted and a copy of this report was left at the facility.
