32 | The investigation determined as follows:
The LPA interviewed four of four staff members. All four staff members stated they have never witnessed or heard staff yell at residents. Three of the four staff members stated that residents clothing needs are addressed by their responsible parties when applicable. Staff further stated that if a resident does not have a responsible party and lacks adequate clothing, the Administrator purchases clothing to ensure the resident's needs are met. One staff member stated that residents toiletries, hygiene products, and other basic personal care supplies are provided through insurance, ensuring residents have access to necessary items.
LPA interviewed six of the seven residents residing at the facility. Of the residents interviewed, five were nonverbal or had a diagnosis of dementia and were unable to provide reliable statements regarding the allegations. Three residents were able to communicate that they were happy living at the facility. One resident specifically stated that their basic needs were being met. No residents interviewed expressed concerns regarding staff treatment, unmet basic needs, or the facility environment. During the inspection, the LPA observed the facility to be clean, orderly, and free of any immediate health or safety hazards. Resident bedrooms and common areas were appropriately furnished, maintained at a comfortable temperature, and provided adequate lighting, seating, and space for residents to move about safely. The LPA observed residents to be appropriately dressed, well groomed, and appearing comfortable and well cared for. The LPA did not observe any conditions that would indicate residents were living in an unsafe or uncomfortable environment. Additionally, the LPA did not observe any staff interacting with residents in a manner that appeared inappropriate, disrespectful, or verbally abusive.
Based on interviews, record review, and the LPA observations, there was insufficient evidence to support the allegations that staff failed to provide a safe and comfortable environment, failed to ensure residents' basic needs were met, or yelled at residents. Therefore, the allegations are unsubstantiated, meaning that although the allegations may have occurred or are valid, there is insufficient evidence to prove or disprove the allegations.
An exit interview was conducted with the facility representative and a copy of this LIC9099 and LIC9099-D, along with a copy of the appeal rights was left at the facility. |
