Regarding the allegation: Staff is financially abusing residents
8 of 10 individuals denied the complaint allegation and/or could not provide any corroborating information or evidence to support the complaint allegation. 2 individuals were unresponsive during attempted interviews. According to S1, all the residents in the facility were Regional Center clients and the regional center paid the facility for the clients. The facility managed their P&I finds and that was it. Multiple residents interviewed confirmed they received their money when it was requested and did not have any problems with receiving their P&I funds. Resident 2 (R2) and Resident 4 (R4) both stated they have never been denied access to any of their money. According to S1, R1’s monthly payments have been on auto pay and are paid automatically ever since the resident was with the public guardian.

Regarding the allegation: Staff monitor residents via hidden cameras.
8 of 10 individuals denied the complaint allegation and/or could not provide any corroborating information or evidence to support the complaint allegation. 2 individuals were unresponsive during attempted interviews. S1 confirmed there were cameras in the common areas and said when Licensing Program Analyst and a Licensing Program Manager came to the facility during a previous visit, they were told to take the cameras down. All the residents who were interviewed were aware of cameras in the kitchen and near the TV. All the residents denied the presence of cameras in their bedroom.

Regarding the allegation: The Licensee did not provide proper notice of increase in rate.
S1 denied the allegation and claims the facility never raised the rent. According to S1, Regional Center were responsible for how much the clients paid in rent and were responsible for paying Silver Lining Manor for the residents. S1 explained the Regional Center determined how much the monthly rent would be based off the cost of living. S1 explained Regional Center would initiate any increase in the monthly fees based off the cost of living.

Based on the information gathered during the investigation through interviews and document review, the Department is unable to ascertain if the allegations occurred as reported. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove or refute the alleged violations occurred; therefore, the allegations are deemed Unsubstantiated.

An exit interview was conducted, and a copy of this report was provided to staff.
