It was alleged that staff are not meeting resident's needs. Information received indicated that Resident #1 (R1) required higher level of care, but staff refused to provide proper care stating that R1 could leave the facility at any time.
LPA’s review of R1’s records revealed that R1 was a legally blind person who required total assistance with activities of daily living from staff. LPA conducted an interview with R1, who stated that staff members provided assistance with all activities of daily living, and R1 was satisfied with the staff assistance. R1 wanted to relocate and live independently like before but did not know how to relocate. R1 wanted someone to help relocate and live independently.

LPA conducted interviews with nine (9) residents, all of whom stated that staff provided all the care they required. LPA conducted an interview with Staff #1 (S1), who stated that staff provided in the past and will assist R1 with relocation process. However, R1 was not accepted by any places that R1 chose to relocate. Staff will continue to assist R1.

Based on records review and interviews conducted, the evidence found during the investigation did not meet the preponderance of evidence standard. Therefore, this allegation is unsubstantiated at this time.

A finding that the complaint is UNSUBSTANTIATED means the allegation may have happened or is valid, but there is not a preponderance of the evidence to prove that the alleged violation occurred.

An exit interview was conducted where a copy of this report was provided.

LPA’s review of R1’s records revealed that R1 was a legally blind person who required total assistance with activities of daily living from staff. LPA conducted an interview with R1, who stated that R1 wanted to leave this facility and relocate to a different place to live. R1 stated that R1 just wanted to go out, so R1 walked out of the facility and went into a building nearby. R1 stated that a few staff members followed. LPA conducted an interview with Staff #1 (S1), who stated that 911 was called when R1 walked out of the facility onto the sidewalk. One of the staff members followed R1 all the way to the next building which was Palm Springs Health Care.

Based on records review and interviews conducted, staff members followed R1 for safety when R1 walked out of the facility onto the sidewalk, and it was R1’s choice to just walk out of the facility at the time. The evidence found during the investigation did not meet the preponderance of evidence standard. Therefore, this allegation is unsubstantiated at this time.

It was alleged that staff are rude to resident. Information received indicated that a staff member was rude to Resident #1 (R1) when R1 returned to the facility after wandering onto the sidewalk earlier in the day. But the information was without any further details on who did or what was said to R1.

According to R1’s care plan dated February 9, 2026, R1 required staff escort when leaving the facility due to R1 being a legally blind person. LPA conducted an interview with R1, who stated that R1 wanted to move out of this facility and live independently. R1 stated that some staff members were rude but without any names or details. R1 did not know who was rude when R1 returned from wandering onto the sidewalk. R1 kept on mentioning various subjects during the interview and had to be redirected every time.

LPA conducted interviews with nine (9) residents, all of whom denied experiencing staff members being rude. LPA conducted interviews with three (3) staff members, all of whom confirmed the statements from the residents interviewed.

Based on records review and interviews conducted, the evidence found during the investigation did not meet the preponderance of evidence standard. Therefore, this allegation is unsubstantiated at this time.
