On 9/24/26, Licensing Program Analyst (LPA) Talwinder Bains arrived unannounced to deliver complaint findings for allegations listed above. LPA met with Administrator, Preston Summerhays during today's visit and explained the purpose of the visit.

The department conducted records review and interviews with staff and residents to investigate the complaint. Resident, R1 interview indicated that they were receiving phone calls from their responsible party and not from other individuals. Staff interviewed that they were allowing phone calls only from their responsible party and not from other individuals as instructed by R1s responsible party. Record review indicated that responsible party was R1s Power of Attorney (POA) and Not the Conservator and per current regulations, POA cannot restrict phone calls or visitation for R1 unless there was restraining orders for those individuals from court. Gathered information reflected that facility did not safeguard R1s Personal Rights, therefore this allegation was SUBSTANIATED. Based on the information gathered, the preponderance of evidence standards has been met. Therefore, the above allegation is found to be SUBSTANTIATED. Per California Code of Regulations, Title 22, Division 6, Chapter 8, deficiency is being cited on the attached LIC 9099-D page.

Exit interview conducted. Appeal rights and a copy of this report were provided.

**Report continued......

Allegation- Staff did not prevent the spread of scabies or other contagious rash. UNSUBSTANTIATED

During the investigation, the Department conducted interviews and reviewed documentation pertinent to the investigation. Based on observation, record review, and statement reviewed, the facility was following universal precautions to address any communicable outbreaks at the facility. It was learnt that facility has some cases of scabies cases at the facility in 2026 and facility followed all required guidelines to handle those cases. From the gathered information, it was evaluated that resident, R1 was not infected with scabies or any contagious rash during their residency at the facility, therefore, this allegation was UNSUBSTANTIATED.

Allegation- Staff did not provide adequate supervision resulting in resident falling and going to the hospital. Staff did not provide adequate supervision resulting in resident injuring their leg in a wheelchair. UNSUBSTANTIATED

The department conducted records review and interviews with staff and residents to investigate the complaint. Resident, R1, interviewed reflected that their care were met at the facility and there were no reportable concerns. Staff interviews indicated that R1 required minimal assistance with their activities of daily living (ADLs) and their care needs were met. Record review indicates that R1 was experiencing knee pain in July 2026 and they hurt their knee during self-transfer with walker and were sent to hospital to seek medical care in last week of July. After their knee treatment, they were sent to skilled nursing facility for rehab and they came to the facility after few weeks. During the investigation, it was noted that R1 was getting physical therapy services at the facility and was learning to ambulate again with walker and their condition was improving. From the gathered information, there were insufficient information regarding R1s leg injury were due to lack of care and supervision of staff, therefore this allegation was UNSUBSTANTIATED.

A finding that the complaint allegations is UNSUBSTANTIATED means that although the allegations may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.

Exit interview conducted. A copy of this report was provided.
