Licensing Program Analyst (LPA), Tiffany Holmes conducted an unannounced complaint visit to deliver findings on the above-mentioned allegations. LPA met with Ron Alamario, Assisted Living Director and we discussed the allegations.

LPA conducted interviews, made observations, and obtained and reviewed pertinent records. It was alleged that the facility is in disrepair and that the facility falsely advertised amenities. Interviews revealed that the facility advertises what they are offering. Interviews revealed that the sales department offers new residents the option of a light refurbish and full refurbish apartment home. The prospective resident will then choose which one they want. Interviews revealed Resident 1 (R1) signed the Reservation document stating they would take the apartment home with a light refurbish while they were with their realtor on 12/18/2025. Interviews revealed that R1 wanted to change the paint since it was a light color and change the flooring. Interviews revealed the appliances were used but were still in good condition operable and clean. Interviews revealed they had normal wear and tear, no bugs and there was one little nick on the fridge. There was no rust and the sales department did not make any promises to R1 about possibly changing them out.

Interviews revealed on a full refurbish, appliances are sometimes not swapped out if they are still operating. The unit was sold to R1 as a light refurbish as is. Interviews revealed that R1 and their realtor picked out the paint and the flooring off the selection sheet without R1s family. On another day R1 came in with their adult child and they were concerned about the unit and the sales department was able to advise them it was a light refurb. On a different day they met with R1 and their two children and they were saying the apartment was not move in ready and that the appliances should be replaced. Interviews revealed that R1 knew that the light refurb comes with used appliances but their children did not.

Interviews revealed that R1's children wanted another unit that was a full refurbish with all new paint, flooring, cabinets and appliances, literally gutted out and brand new. Interviews revealed the family was told they had another unit that will become available in 2-3 weeks that had the same lay out, same building but not the same cost. Interviews revealed the sales department talked to the family and walked them to the other unit and they were weighing their options and a few days after this they wanted new appliances in the new unit that was a light refurb also. Interviews revealed the sales department was willing to give them a new dishwasher and fridge only. Interviews revealed the family was not in agreement with that and wanted the sales department to replace the fridge, stove, microwave and dishwasher. Interviews revealed that the children expressed dissatisfaction with the appliances and they gave them two options one which was brand new and at first R1 said yes then changed their mind and decided to keep the original apartment. Interviews revealed that staff did observe a few spiders and tried to explain to the family that they called the terminator to the unit so prior to R1 moving in it would be all clear and they reiterated to them that the unit had been empty since December of 2025 and it was now March/April 2026. Interviews and a review of signed documents reveal R1 signed the selection sheet on 01/09/2026, they met with the children on 2/26/26 and explained to them that a full refurb involves updating to current finishes, appliances, countertops and millwork, lighting, showers/tub replacement plumbing, draperies, cabinets and flooring. A light refurb was flooring, minor repairs, appliances (if needed) Minor millwork or counter tops (if needed) painting. On 02/26/26 R1 came with their two children to look at the community and see their apartment on that day they had quite a bit of concerns and questions about the unit. They spoke with the facilities maintenance team so they could address the concerns with them. They confirmed with the refurb team that the apartment would be cleaned and ready to put items in on Tuesday of the next week. R1's contract was signed on 3/16/2026 and their move in date was scheduled for 3/18/2026. Interviews later revealed that on 04/23/2026 the facilities maintenance purchased all new appliances for R1s apartment that later R1 did not accept.

The Department has investigated the above-mentioned allegations and based on interviews, LPA observations, and records review, it was determined that the complaint allegations are Unsubstantiated. The allegations may have happened or is valid, but there is not a preponderance of the evidence to prove that the alleged violation occurred.

An exit interview was conducted, and a copy of this report was left at the facility with Ron Alamario Assisted Living Director and was provided a copy of the Appeal Rights (LIC 9058 3/22) and their signature on this form acknowledges receipt of these rights.
