Licensing Program Analyst (LPA) Renita Hall conducted a phone interview with the Licensee/Administrator to deliver the findings regarding the complaint investigation.

It was alleged that neglect/lack of supervision resulted in sexual abuse of a resident in care and that the licensee did not follow reporting requirements.

The Department’s investigation consisted of interviews and record review. Investigation revealed that on 10/04/20, at about 2030 hours, Resident #1 (R1) reported to Staff #2 (S2) that her roommate Resident #2 (R2) had inappropriately touched her while R1 was showering. R1 also reported that R2 made sexual comments that made R1 feel uncomfortable due to her own history of sexual abuse. S2 agreed to move R1 to another room temporarily for the night until management could arrange a permanent solution for R1.

The following day, Staff #1 (S1) spoke to R1 and R2 about the incident. S1 was unable to move residents around and asked they stay one more night in the room. S1 had caregivers check on R1 and suggested leaving the door open. Later that evening R1 reported to S2 that she felt uncomfortable in the room with R2 and again requested to stay in a different room, all rooms were occupied and S2 was unable to accommodate R1.

On 10/06/20 at 0830 hours, R2 was moved out of the shared room and R1 was able to occupy the room alone. No further incident occurred after the move and both residents continued to reside at the facility. The staff provided timely accommodations to resident R1 the first night she reported the incident and attempted to find a safe solution within reasonable timely manner. However, management allowed alleged suspect R2 to remain in the same room the second night with R1 placing her in an unsafe situation and failed to provide adequate supervision or care after she reported again to staff of feeling unsafe with R2. A review of the incident report submitted by S1 revealed that S1 failed to report the details of the inappropriate interaction and failed to complete an abuse report as a mandated reporter.

Based on interviews and records, the preponderance of the evidence standard has been met. Therefore, these allegations are substantiated.

An exit interview was conducted with the Licensee. A copy of this report and Licensee's Rights (LIC 9058/03/22) was provided via email to the Licensee.
