Also, residents mentioned unrelated issues including better communication with management about ongoing construction, incompatibility of personalities between residents resulting in frequent yelling, but no concerns were raised regarding staff behavior been inappropriate while assisting residents with incontinence care. LPA conducted interviews with staff (S1, S2, S3, S4, S5 & S6) who indicated which residents tend to exhibit aggressive behaviors, but R1 was only mentioned by three staff describing their protocols to handle these types of behaviors when residents become aggressive which include attempts to calm them down, leave them alone for some time and returning later to assist them with their care needs. However, staff interviewed did not have knowledge about any incidents where someone could assist residents in an inappropriate form when assisting them with incontinence care. Based on records review, LIC500 Personnel report indicates that there are four staff who work night shift, but usually there are two staff assigned to assist R1 with incontinence care. R1’s physician report dated 7/21/26 indicates that R1 has a cognitive condition, behavioral expressions including elopement attempts, history of skin breakdown where preventive skin care including routine application of barrier cream to the sacral area and ongoing skin monitoring is prescribed. Additionally, licensee provided written communication with R1’s responsible party discussing the possibility to adjust R1’s medications due to attempts to elope the facility and refusal of medications, which it was confirmed by R1’s responsible party who stated that R1 has been exhibiting cognitive decline including verbalizing incidents, persons or places that never occurred by mentioning to them that staff has been torturing them because they wake them up in the morning to take showers and they don't like to take showers in the morning because its cold. Based on interviews with pertinent parties and records reviews did not reveal any supporting evidence that could indicate that R1’s personal rights have been violated at any given time. A finding that the complaint allegation of personal rights is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is UNSUBSTANTIATED. |
